Terms of Service

1. What Coachly does

Coachly is a sales-training game. You practice spoken sales conversations against fictional buyers played by artificial intelligence, receive automated grades and coaching feedback, and track progress through levels and challenges. Coachly may also show optional job listings, closer profiles, Custom Training scenarios, and strategy-call booking tools.

The service will evolve. We may add, change, rebalance, or remove features when reasonably needed to operate or improve Coachly. We will not use that right to change an already completed App Store transaction.

2. Eligibility

You must be at least 16 years old to use Coachly. If the law where you live requires a higher age to agree to online terms, that higher age applies. By using Coachly, you confirm that you meet the applicable requirement and can enter this agreement.

Your use of the iOS app must also follow the applicable Apple Media Services Terms and App Store rules. If these Terms conflict with mandatory App Store terms that apply to your purchase or use, those mandatory terms control for that issue.

3. Your account

You may sign in with email, Apple, Google, or another supported method. Give accurate information, keep access to your account secure, and do not share or transfer your account. You are responsible for activity performed through your account unless it results from a security failure on our side.

Tell us promptly at support@stackably.info if you believe someone has accessed your account without permission. We may ask for reasonable information to confirm account ownership before changing access or responding to a data request.

4. Coachly Pro Monthly

Payment and auto-renewal

Coachly Pro Monthly is purchased through Apple's App Store. Your Apple ID account is charged when you confirm the purchase or when an eligible free trial ends. The subscription renews for another one-month period unless you cancel it. Apple charges your account for renewal within 24 hours before the current monthly period ends.

Starting a 7-day free trial enrolls the subscription in auto-renewal. Unless you cancel at least 24 hours before the trial ends, Apple will charge the localized monthly price shown at purchase. Deleting Coachly or deleting your Coachly account does not cancel the subscription.

Cancellation

Cancel through iOS Settings → Apple ID → Subscriptions → Coachly → Cancel Subscription. Cancel at least 24 hours before the next renewal or the end of the trial. After cancellation, access normally continues until the end of the paid period. We cannot cancel an Apple subscription from our servers.

Refunds and restore purchases

Apple handles billing questions and refund requests under its policies. You can request a refund or review Apple's process at Apple Support. We cannot issue an App Store refund directly.

To restore an eligible purchase, open Coachly and go to Profile → Settings → Restore purchases while signed in to the Apple ID that made the purchase. If access does not return, contact us with the Coachly account email and do not send payment-card details.

Price or plan changes

Apple will show or communicate any subscription price change as required by its rules and applicable law. A new price does not apply retroactively to a completed billing period. You can cancel before a future renewal if you do not want to continue under changed pricing.

5. Acceptable use

Use Coachly for lawful training and personal development. You must not:

• Reverse engineer, decompile, bypass, extract, or attempt to discover our non-public prompts, models, grading logic, security controls, or source code, except where law expressly permits it.
• Scrape Coachly, use bots or automated access, overload the service, probe for vulnerabilities, or interfere with another person's use.
• Cheat, manipulate scores, exploit bugs for advantage, or falsify Coachly performance when applying for work.
• Use the service to create or direct unlawful, abusive, hateful, sexual, threatening, or otherwise harmful content.
• Impersonate another person, misrepresent your identity or authority, or use a fictional buyer's voice or output to deceive someone into believing it is a real person.
• Copy, resell, sublicense, or commercially exploit Coachly or its content without written permission.

If you find a vulnerability or a bug, report it to us instead of exploiting it.

6. Coachly intellectual property

Coachly, its software, visual design, branding, prompts, scenarios, grading methods, reports, level structures, and fictional characters—including characters such as Gary—are owned by Stackably LTD or licensed to us. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the app for its intended purpose. They do not transfer ownership of Coachly or its content to you.

Third-party names, platforms, and services remain the property of their respective owners. Feedback you voluntarily send us may be used to improve Coachly without payment to you, but it does not give us ownership of unrelated ideas or work you already owned.

7. Your content

You keep ownership of the original inputs you provide, such as what you say in a practice call, the industry text you enter for Custom Training, and information you submit with a job application. You give us a limited, worldwide license to host, transmit, reproduce, analyze, and process that content only as reasonably needed to deliver, secure, support, and improve the service and to comply with law.

This processing includes transcribing a spoken turn, sending relevant call text to AI providers, generating the fictional buyer's response and coaching report, storing the transcript for your history, and sharing an optional job application with the relevant listing party. You are responsible for having the right to submit your content. Do not include confidential client information, payment details, health information, trade secrets, or another person's personal data in a practice call.

8. Progress and virtual items

XP, coins, hearts, streaks, stars, grades, and other in-app progress have no cash value, cannot be transferred or exchanged outside Coachly, and are licensed rather than sold. We may rebalance or correct them to operate the game, including reversing rewards caused by a bug or abuse. Account deletion removes unused progress and virtual items.

9. Jobs, closers, and third-party services

Job listings, listing companies, closer profiles, Calendly booking pages, identity providers, and App Store services are provided partly or entirely by third parties. We do not employ every listed company or closer, guarantee that a listing is accurate or available, promise an interview or offer, or become a party to an employment, coaching, or booking arrangement you make with them.

Third-party services have their own terms and policies. You are responsible for reviewing them before completing a purchase, sign-in, application, or booking.

10. AI training aid and disclaimers

Every buyer in a Coachly practice call is a fictional AI character. No real customer, company, or deal is on the line. AI systems can produce inaccurate, incomplete, unexpected, or objectionable output. Grades and feedback are automated training aids, not a verified assessment of your ability and not professional, legal, financial, employment, or business advice.

Coachly is provided “as is” and “as available.” We do not promise uninterrupted access, error-free transcripts, perfect grades, a particular job or sales outcome, or that every suggestion will fit a real conversation. Use your judgment before applying an AI-generated line in the real world. Nothing in these Terms removes a warranty or consumer right that applicable law does not allow us to exclude.

11. Limitation of liability

To the maximum extent permitted by law, Stackably LTD is not liable for indirect, incidental, special, punitive, or consequential loss, including lost profits, lost opportunities, lost data, or business interruption, arising from Coachly. Our total liability for all claims relating to the service is limited to the amount you paid for Coachly in the 12 months before the event giving rise to the claim.

This limit does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot legally be limited. It also does not reduce non-waivable rights you have as a consumer.

12. Suspension, termination, and account deletion

You can stop using Coachly at any time and can delete your account from Profile → Settings → Delete account. You may also request deletion at support@stackably.info. Remember that account deletion does not cancel an Apple subscription.

We may restrict, suspend, or terminate access if you materially violate these Terms, abuse the service, threaten its security, or create legal risk for us or others. Where practical and appropriate, we will explain the reason and give you a chance to fix the issue. Provisions that logically need to continue—including ownership, disclaimers, liability limits, and governing law—survive termination.

13. Changes to these Terms

We may update these Terms as Coachly changes. For a material update, we will give reasonable notice in the app or through another appropriate channel before it takes effect. Continuing to use Coachly after the effective date means you accept the updated Terms. If you do not accept them, stop using the app and delete your account.

14. Governing law

These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law rules. The courts of Cyprus have jurisdiction over disputes relating to these Terms, except where the law in your country gives you a mandatory right to bring a claim in your local courts or applies other non-waivable consumer protections.
